Terms of Use and Warranty

Biblical Research & Education Resources, hereinafter referred to as BRER, is an on-line web site on the World Wide Web, http://www.blainerobison.com, established March 26, 2004, produced, owned and operated by Blaine Robison, USA. The BRER Site includes content, information and various document and electronic resources provided by the owner. By using the BRER Site and its services the user agrees to comply with all the following terms and conditions of use:

Ownership. The selection and arrangement of text, photos, graphics and any audio or visual elements, as well as specific content on the BRER Site are considered proprietary of Blaine Robison, unless otherwise identified. This website and the articles, documents and publications included herein are protected under U.S. and international copyright laws. Subject to the terms of this Policy no part of this website and its contents may be downloaded, reproduced, stored in a retrieval system or transmitted in any form by any means, electronic, photocopy, or otherwise, without the prior permission of the author, except for brief quotations in critical reviews or articles.

Third Party Links. The BRER Site provides links to other websites strictly for information purposes to BRER users. Blaine Robison has no editorial or other control over such websites. The opinions, statements, or information offered by such third party websites are solely the property of the third party. The third party link does not constitute an endorsement of the content or advertising of products and services that might appear on such websites. Blaine Robison is not an "authorized agent" of nor is there any other formal affiliation with the organizations or companies that own the websites.

Editorial Content. The BRER Site is not an egalitarian website. User acknowledges that the opinions and interpretations and application of Scripture are solely those of the author and do not necessarily reflect the views or positions of any other individual, organization, corporation, church or denomination. The author is not obligated to give website space to alternative viewpoints or answer contrary viewpoints. Under no circumstances will Blaine Robison be liable for any loss or damage caused by a user's reliance on information obtained through the BRER Site. It is the responsibility of users to evaluate the accuracy of any information, opinion, or any other content on the BRER Site or third party linked websites.

Limited Copying Permission. The user is hereby granted a limited reproduction permission and may download or copy material on the BRER site strictly for personal or educational use only. Articles or web pages must be reproduced in their entirety and the author's copyright notice must appear on all authorized copies. Users who wish to reproduce website materials for educational purposes must notify the author in writing (email is acceptable) and briefly explain the nature of the use, the location and the number of copies that will be made.

Restrictions on Access and Copying. Users may not:

1. Copy, reproduce or use material on the BRER Site without the express written permission of Blaine Robison. In the event material is downloaded and/or copied, no changes shall be made in the trademark, copyrights or attribution of the author or third parties. The user does not acquire any ownership rights by downloading the material located on the BRER Site.

2. Alter or modify any web page on this website.

3. Sell, rent, lease, sublicense or transfer any article or document on this website to anyone.

4. Alter or modify the format of PDF documents in any way or seek to defeat the Acrobat security settings.

5. Remove, obscure or omit the author’s copyright notices wherever they appear, including on authorized copies.

6. Store any downloaded or copied article or document in a network server or multiple-user arrangement unless you pay for and obtain a separate license for each computer terminal from which the material will be accessed.

User Submissions. Users may provide reviews, comments, other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. In the event the user submits material to the BRER Site, he/she also grants Blaine Robison the right to edit, copy, publish and distribute such material, and has expressly granted Blaine Robison a royalty-free, worldwide, perpetual, non-exclusive right and license to use and distribute such material.

Material which is protected by copyright, trademark or other propriety right, may not be uploaded on the BRER Site or emailed to Blaine Robison without the express permission of the owner of that copyright, trademark or other proprietary right. You represent and warrant that you own or otherwise control all of the rights to the content that you submit; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify BRER for all claims resulting from content you supply. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.

Privacy. This website does not use cookies and collects no personal information from the user.

Warranty. Blaine Robison does not warrant the accuracy or reliability of any content or information provided through the BRER Site, or that the BRER Site will be uninterrupted and error free. The BRER Site is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. User expressly agrees that use of BRER Site is at the user's sole risk.

Waiver of Liability. This disclaimer of liability applies to any damages or injury caused by any failure of performance error, omission, interruption, deletion, defect, delay in operation or transmission, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. User specifically acknowledges that Blaine Robison is not liable for the defamatory, offensive or illegal conduct of other users and that the risk of injury from the foregoing rests entirely with the user. In no event shall Blaine Robison or any person or entity involved in producing or distributing the BRER Site be liable for any damages, including, without limitation, direct, indirect, special, consequential or punitive damages arising out of the issue of or inability to use any of the content on the BRER Site. User agrees to indemnify and hold harmless Blaine Robison from and against all claims and expenses, including attorney's fees, arising out of the use of the BRER Site by the user.

Termination. The user understands that Blaine Robison may, at any time, change or discontinue any feature of the BRER Site, including content, availability, equipment needed for access to the BRER Site, the terms and conditions applicable to the BRER Site or any part thereof. Blaine Robison may also impose conditions for the use of some portions of the BRER Site which shall be effective immediately upon notice thereof on the BRER Site or by email to the user. Any use of the BRER Site after such a notice shall be deemed to constitute acceptance of such changes, modifications or additions.

Modification and Severability. Blaine Robison reserves the right to make changes to the BRER site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Dispute Resolution. For the resolution of any dispute regarding the provisions of this Terms of Use and Warranty that cannot be resolved by mutual efforts the author is willing to submit said dispute to a certified Christian conciliator for resolution and settlement.
